Terms of Use for Retro Shark AI

1. Overview
Retro Shark AI is an AI-powered gaming tool currently under development. The Site is designed to raise funds through pledges in support of this development. This Site is not a retail platform and does not currently sell any finished products. All funds raised are used exclusively to support the development and production of Retro Shark AI.
2. No Guarantee of Product or Perks
By pledging on this Site, you acknowledge and agree that your pledge is not a pre-order or purchase of a product. AI Shark LLC will make reasonable efforts to develop the Retro Shark AI product and deliver promised rewards; however, we do not guarantee that development will be successful, that the final product will be delivered, or that it will be delivered in any particular form, scope, or timeframe. Circumstances outside our control, such as technical setbacks, supply chain issues, or changes in legal or regulatory frameworks, may impact delivery.
3. Funding and Refund Policy
The minimum funding goal is $50,000. If the goal is not met, AI Shark LLC will refund the portion of your pledge exceeding $15. $15 from every pledge is non-refundable and covers campaign and administrative costs. If the funding goal is met, all pledges are final and non-refundable. AI Shark LLC will not be held liable for any losses or expenses incurred due to project delays or modifications. By pledging, you waive any right to demand the return of funds, except as explicitly stated herein.
4. Project Timeline
The estimated timeline for Beta release is 6 months following the successful funding of the project. This is an estimate only and is not binding. Product development may be faster or slower than expected depending on internal and external factors, including staffing, technology availability, or unforeseen circumstances. AI Shark LLC will make good-faith efforts to meet published timelines and will communicate updates via the Site and official channels.
5. Campaign Owner Responsibilities
AI Shark LLC agrees to: – Use pledged funds solely for project development and operation, – Make good-faith efforts to fulfill all promised rewards, – Provide periodic public updates on progress, – Inform backers promptly of any material delays or changes. AI Shark LLC may, at its discretion, offer alternate rewards, partial refunds, or updated development timelines in lieu of original plans if significant changes arise.
6. Platform Disclaimer
This Site and any third-party platforms used to process pledges or communicate with users are not liable for the project’s execution or success. All obligations are solely those of AI Shark LLC. Use of this Site does not create any relationship between the user and any crowdfunding platform provider.
7. Legal Agreement
These Terms constitute the full legal agreement between you and AI Shark LLC. Any other agreements, verbal or written, shall be considered void unless explicitly included in this document. Any rewards, updates, or communications not published directly by AI Shark LLC are non-binding.
8. Intellectual Property
All trademarks, logos, software code, designs, visuals, and text found on this Site or in Retro Shark AI promotional material are the property of AI Shark LLC or its licensors. No portion of the content may be copied, republished, or used without prior written consent. Unauthorized use may violate intellectual property laws and will be prosecuted to the fullest extent.
9. User Content and Feedback
If you submit comments, feedback, suggestions, or other materials to us, you agree to grant AI Shark LLC a worldwide, irrevocable, royalty-free license to use, reproduce, and adapt such content. You waive any moral rights or claims for compensation related to use of your feedback.
10. Emulators and ROM Responsibility
Retro Shark AI is being developed to work with existing third-party emulator software and user-owned ROMs. AI Shark LLC does not provide, promote, endorse, or distribute ROMs or emulators, nor does it facilitate the illegal use of copyrighted materials. Users are solely responsible for ensuring that their use of emulators and ROMs complies with applicable laws, including copyright, trademark, and fair use standards.
Retro Shark AI is intended as a general-purpose tool that enhances gameplay experiences through AI-based suggestions and features. It does not contain any embedded game content, nor does it alter or circumvent any technological protection measures in commercial software. Any use of the Product in conjunction with unlicensed or pirated software is strictly at the user’s discretion and risk.
AI Shark LLC disclaims all liability for any copyright infringement or other unlawful activities carried out by users, whether intentionally or otherwise. By using Retro Shark AI, users agree to indemnify and hold harmless AI Shark LLC from any claims, actions, or damages resulting from their misuse of third-party software or violation of intellectual property rights.
11. Eligibility
You must be 18 years or older to pledge. By pledging, you represent that you are legally able to enter into contracts and assume full responsibility for your actions and obligations under these Terms.
12. Privacy
Use of the Site is subject to our Privacy Policy, which explains how we collect, use, and protect personal data. You consent to this data collection by accessing or using the Site.
13. No Professional Advice
Nothing on the Site should be construed as legal, investment, financial, or tax advice. Please consult your own advisors regarding any such matters.
14. Limitation of Liability
AI Shark LLC disclaims all liability for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of the Site, your pledge, or any issues arising from product development. Our maximum aggregate liability shall not exceed the amount of your pledge.
15. Modification of Terms
AI Shark LLC reserves the right to modify these Terms at any time. Any changes will take effect upon posting the updated Terms on the Site. You agree to review these Terms periodically. Continued use of the Site constitutes acceptance of any changes.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
